YWCA Hunter – Auditorium / Basketball Court Hire – Waiver and release details

In this Waiver, YWCA Hunter means YWCA Hunter Region Inc.; Facilities means all sports and activities facilities owned or operated by YWCA Hunter; and Equipment means all sports and activities equipment owned or provided by YWCA Hunter at the Facilities.

The hirer AGREES to comply with all lawful directions of YWCA Hunter and its officers, employees, agents and contractors.

The hirer ACKNOWLEDGES AND AGREES that they are responsible for all damage to the Facilities or Equipment caused by them or guests, whether willfully or negligently.

The hirer ACKNOWLEDGES AND AGREES that the activity organised or conducted by YWCA Hunter or otherwise conducted in the Facilities is in the nature of sport and as such, may have inherent dangers and risks, including risk of injury or death.

The hirer FURTHER ACKNOWLEDGES AND AGREES that due to the nature of the activity, it would be unreasonable for YWCA Hunter to be in any way responsible for any injury or death suffered by them and by this, to the full extent permitted by law, the participant WAIVES all of their legal rights of action against and fully release YWCA Hunter for loss, damages, injury or death howsoever arising out of or in relation to their participation in the activity conducted or organised by YWCA Hunter including without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of YWCA Hunter, its office bearers, directors, employees or agents.

The hirer FURTHER ACKNOWLEDGES AND AGREES that they have undertaken the activity freely, voluntarily and absolutely at their own risk and with a full appreciation of the nature and extent of all risks involved in the activity. This waiver binds the hirer and their executors.

I have duly informed the guests of my booking, the risks which I have been made aware of and that there are risks that are unknown to me. I, on behalf of my group accept these risks.

By completing and submitting the “YWCA Hunter Venue Hire Auditorium/Basketball Court Booking Details and Information” form, I acknowledge I have read and understand this waiver of my/guests legal rights. I am indicating my acceptance to these terms and conditions.
